(“Figo” or the “Company”) in its capacity as data controller, in order to inform you in your capacity as data subject in a manner compliant with the legislation, within the scope of Article 10 of the Personal Data Protection Law No. 6698 (Kişisel Verilerin Korunması Kanunu, “KVKK”, the “Law”), the Communiqué on the Procedures and Principles to Be Followed in Fulfilling the Obligation to Inform (Aydınlatma Yükümlülüğünün Yerine Getirilmesinde Uyulacak Usul ve Esaslar Hakkında Tebliğ), and the Guidelines on Cookie Practices. For Which Purposes Personal Data Will Be Processed and the Legal Grounds

The processing conditions set out in Articles 5 and 6 of the Personal Data Protection Law also find an area of application for this cookie policy. In this framework, where personal data processing relies on one of the conditions other than explicit consent contained in the Personal Data Protection Law, there is no need to obtain explicit consent from the data subject.

Data to Be Transferred to the Firm Supplying the Cookie Management Panel
Our Company works with the firm CookieSuite within the scope of the cookie management panel service. Within the scope of the panel service, your IP address, the time and date of your preference, and the approval/rejection status of the preferences you have given for the cookie categories are recorded by the firm with the necessary administrative and technical measures taken. Apart from this information, no information that would identify you is shared with the firm in any way. The firm uses servers whose infrastructure is located in Türkiye. Since proving the status of your cookie consent is the responsibility of our Company, the said information is transferred within the scope of our legal obligation and our legitimate interest pursuant to Article 5/2 (ç) and (f) of the Law.

Collection and Transfer of Cookies

Rights of the Personal Data Owner Listed in the Law
As a personal data owner, if you submit your requests regarding your rights by the methods set out below, Figo will conclude the request as soon as possible and within thirty days at the latest, depending on the nature of the request. No fee will be charged for up to ten pages of the response to be given. For each page above ten pages, the tariff determined by the Personal Data Protection Authority (Kişisel Verileri Koruma Kurumu) will be applied.
In this context, in relation to your personal data;
- To learn whether personal data is processed, and if personal data has been processed, to request information about it,
- To learn the purpose of the processing of personal data and whether it is used in accordance with its purpose,
- To know the third parties to whom personal data is transferred domestically or abroad,
- To request the correction of personal data in the event that it has been processed incompletely or incorrectly, and to request that the action carried out in this context be notified to the third parties to whom the personal data has been transferred,
- To request the deletion or destruction of personal data in the event that the reasons requiring its processing cease to exist, even though it has been processed in accordance with the Law No. 6698 and the provisions of other relevant laws, and to request that the action carried out in this context be notified to the third parties to whom the personal data has been transferred,
- To object to a result arising against the person themselves through the analysis of the processed data exclusively by automated systems,
- To request the remedy of the damage in the event of suffering damage due to the unlawful processing of personal data
are the rights you have.

In the application that you will make in order to exercise the rights you have as Data Subjects and which are stated above, and that contains your explanations regarding the right you request to exercise; the matter you request must be clear and comprehensible, the subject you request must be related to you personally or, if you are acting on behalf of someone else, you must be specially authorized in this regard and your authority must be documented, and the application must meet the minimum application requirements set out in Article 13 of the Personal Data Protection Law and in the Communiqué on the Procedures and Principles of Application to the Data Controller (Veri Sorumlusuna Başvuru Usul ve Esasları Hakkında Tebliğ).

In your application;
- your name, your surname and, if the application is in writing, your signature,
- for citizens of the Republic of Türkiye, your Republic of Türkiye Identity Number (T.C. Kimlik Numarası); if you are a foreign national, your nationality, your passport number or, if any, your identity number,
- your place of residence or place of business address that forms the basis for notification,
- if any, your electronic mail address, telephone and fax number that form the basis for notification,
- the subject of your request,
must be present, and information and documents relating to the matter, if any, must also be attached to the application.
Among the petitions submitted to the Company; those that do not contain a specific subject, those relating to matters falling within the duty of the judicial authorities, and applications that do not bear your name-surname and signature and your business or residence address cannot be examined.
